By accessing and using this Site and/or registering for and participating in the Papa Gino’s/D’Angelo Rewards Program (the “Rewards Program”) you agree to the following Terms and Conditions of the Rewards Program and the laws and regulations outlined therein. If you do not agree and accept these Terms and Conditions, please do not use this Site or participate in the Rewards Program.

The following details the rules of the Rewards Program, which may be changed from time to time in accordance with these Terms and Conditions. We reserve the right to modify these Terms and Conditions at any time. Any changes are effective when they are posted to this Site, and your continuing use of the Site and/or the Rewards Program indicates that you accept the changes that have been made.

Ownership of Website Content: All of the contents of this Site, including all text, videos, music and images, are owned and copyrighted by Papa Gino’s/D’Angelo and are protected as our intellectual or proprietary property. Use of any of the Site content without prior consent by Papa Gino’s/D’Angelo, except as provided in these Terms and Conditions, is strictly prohibited.

Limitation of Liability and Disclaimer: Use of this Site is at your own risk. Neither Papa Gino’s/D’Angelo, their subsidiaries, affiliates, officers, directors or employees, nor any other party involved in the creation or delivery of this site is liable for any direct, indirect, special, consequential or other damages or losses that may result from accessing this Site or from the use of information, services or merchandise provided through Papa Gino’s/D’Angelo.

This Site and the information included on the Site are provided “as is” without any warranty of any kind, either expressed or implied, including but not limited to, the implied warranties of merchantability, quality and fitness for a specific purpose, or non-infringement of third-party rights. Papa Gino’s/D’Angelo make no warranties that the information on this Site will be accurate, error free, or up-to-date.

Sweepstakes, Contests and Other Promotions: This Site may offer sweepstakes, contests or other promotions that may have official rules that outline eligibility, registration, prizes and other information specific to the promotion. You are required to read those rules and determine if you want to participate in such promotions.

Privacy: To participate in the Rewards Program, you will need to become a Member by establishing an account with respect to which we will ask you to provide personal information such as name, postal and email addresses, and telephone and cell phone numbers. Any information that you provide to us will be treated in accordance with our Privacy Policy. Communications that you send to the Site such as questions are considered to be non-confidential and non-proprietary.

Reward Program Rules: Papa Gino’s/D’Angelo offers the Rewards Program as our way of showing appreciation for the loyalty of our guests, by awarding them points based on the amount of their purchases of food and beverages at Papa Gino’s/D’Angelo restaurants or online, and allowing such guests to redeem those points for rewards that can be used to obtain discounts on future purchases of food and beverages from Papa Gino’s/D’Angelo. The Rewards Program is available only to persons who are 13 years of age or older when they register to become members (“Members”) of the Rewards Program, and it is only accessible to registered Members. In order to register for the Rewards Program, you must complete a registration form that includes your name, postal and email addresses, a password, telephone and cell phone numbers. The registration form will also ask several brief questions to determine more about the Member. These questions are used by us to develop marketing programs that will be of interest to individual Members.

Once they are registered for the Rewards Program, Members will be awarded points equal to the price of the food and beverages that they purchase at Papa Gino’s/D’Angelo restaurants or online. The value of such purchases will be rounded up or down to the nearest dollar when calculating points. Promotional/bonus points may be awarded from time to time to Members, as a way to reward individual Members for specific behavior, and such points awards are not governed by rules of chance. Papa Gino’s/D’Angelo reserve the right to offer different amounts of promotional/bonus points to different Members based on their historical patterns of purchasing and Rewards Program point accumulation.

The following rules govern the Rewards Program and may be changed at any time in accordance with the Terms and Conditions of the Rewards Program. Changes will become effective when they are posted on this Site, and a Member’s continued use of the Rewards Program will constitute the Member’s acceptance of the changes. Papa Gino’s/D’Angelo reserve the right to cancel the Rewards Program at any time. By registering in the Rewards Program and agreeing to the Terms and Conditions the Member agrees to receive member communications including promotional offers and account updates via email.

(a) The Rewards Program is available only to persons who are age 13 or older when they complete the registration process to become a Member. Accounts with discounted pricing, such as schools and Court Houses, are not eligible to participate in the Rewards Program.

(b) One point will be awarded to a Member’s Rewards Program account for each dollar that the Member spent on purchases of food and beverages from Papa Gino’s/D’Angelo (rounded up or down to the nearest dollar).

(c) Points will not be awarded for any items such as taxes and driver tips.

(d) Points will automatically be converted, as soon as the minimum number of banked points (“hurdle rate”) is achieved, for rewards that can be used to obtain a specified dollar amount of discount off the price of a future purchase of food and beverages at Papa Gino’s/D’Angelo. Partial awards cannot be given for amounts of points that are less than the defined hurdle rates.

(e) Reward hurdle rates are subject to change at any time. The current Reward hurdle rate is 50 points for a $5 award.

(f) Rewards will be automatically loaded onto the Member’s Rewards Card, which must be registered with Papa Gino’s/D’Angelo in order to be used to obtain the discount off future meal purchases.

(g) Reward Dollars and free food expire 90 days after the date they were earned.

(h) Reward Points will expire after 90 days of inactivity.

(i) Point values and promotional offers are subject to adjustment by Papa Gino’s/D’Angelo at any time. However, once bonus points are banked, their accumulated value remains static (unless forfeited because of account inactivity).

(j) Rewards Cards will expire after one of inactivity.

(k) Rewards Program points have no monetary value and are not redeemable for cash.

(l) Material posted on this Site is the property of Papa Gino’s/D’Angelo and may not be copied for any reason.

Member Cooperation: Members agree to provide only true and accurate information when registering for the Rewards Program, to comply with the terms of all partner offers, promotions and programs, and that they will not abuse the Rewards Program, such as by accruing points in a manner that is inconsistent with Papa Gino’s/D’Angelo policies.

Termination of Membership: Papa Gino’s/D’Angelo reserves the right to terminate a Member of the Rewards Program in the event of any conduct that Papa Gino’s/D’Angelo in its sole discretion considers to be in violation of the Terms and Conditions detailed herein. Papa Gino’s/D’Angelo reserve the right to audit Member accounts to determine if any violation or fraudulent behavior has occurred.

General Provisions: These Terms and Conditions are governed by, and construed in accordance with, the laws of the Commonwealth of Massachusetts.
